Terms of sale

These terms apply to every order placed on gemavelle.shop. Please read them before ordering; you will be asked to accept them at checkout. They do not affect your statutory rights as a consumer.
1. Who we are
gemavelle.shop is operated by Hong Kong TV Shopping Network Company Limited, a company incorporated in Hong Kong (Company No. 2037066), registered office 1 Chun Cheong Street, Tseung Kwan O Industrial Estate, New Territories, Hong Kong. Email support@gemavelle.shop, telephone +852 5012 9621. GEMAVELLE is our brand. In these terms “we”, “us” and “our” mean this company.
2. Who can buy
We sell to consumers for their own use, to the delivery destinations listed on our Delivery page. You must be at least 18 years old or have the consent of a parent or guardian.
3. Products and product information
We describe each product with its dimensions, capacity, maximum load, materials and contents as accurately as we can. Photographs show the product in use; bedding, clothing and other items shown for styling are not included unless they are listed under “In the box”. Colours on screen may differ slightly from the real product.
Some products must be fixed to a wall or rely on an adhesive strip. The product page explains what is needed. You are responsible for installation, for choosing fixings suitable for your wall, and for checking that the wall or surface can support the stated load. Do not exceed the maximum load stated for a product.
4. How the contract is made
When you place an order, you make an offer to buy. We send an email confirming that we have received it; that email is an acknowledgement, not an acceptance. The contract is formed when we email you to confirm dispatch. If we cannot accept your order (for example, because an item is unavailable or there is an obvious pricing error), we tell you and refund any payment in full.
Before you place the order you can review and correct your details and the contents of your bag. The order is placed when you click “Place order and pay”, which commits you to pay. We store the details of your order and send them to you by email; you can also see them in your account if you created one.
These terms and the product information are available in English, German, Danish, Swedish and French. The contract is concluded in the language you used to place your order.
5. Prices, currency and taxes
- Prices are shown and charged in the currency of your delivery country (USD, EUR, GBP, DKK or SEK; other destinations in USD). Each price shows its currency code.
- Our prices include all taxes we are required to charge. Hong Kong does not charge VAT or sales tax, and we do not add any.
- Delivery is charged per order and is shown before you pay.
- Import VAT, customs duties or carrier handling fees in your country are not included and are payable by you. See Import VAT, duties and customs.
- We only show a previous price next to a current price if we actually charged that previous price.
6. Payment
Payment is taken when you place your order, using one of the methods shown at checkout. Card payments are processed by our payment service provider; we do not store your card details. See Payment & security.
7. Delivery, risk and ownership
We dispatch within 2 business days and the usual delivery times are set out on our Delivery page. Delivery times are estimates. The goods are your responsibility from the time they are delivered to you or to someone you named. Ownership passes to you when we have received full payment.
8. Returns and right of withdrawal
You may return items within 30 days of delivery under our returns promise. Customers in the EU, the UK and the EEA also have a statutory 14-day right of withdrawal. Both are explained, with the model withdrawal form, on our Returns & refunds page, which forms part of these terms.
9. Your rights under Hong Kong law
Under the Sale of Goods Ordinance (Cap. 26), goods we sell must:
- match the description we gave them;
- be of merchantable quality; and
- be fit for any particular purpose you made known to us before buying.
If they are not, you may reject them and claim a refund, or claim damages.
Under the Control of Exemption Clauses Ordinance (Cap. 71), we cannot exclude or limit these obligations when selling to a consumer, and nothing on this site attempts to. If you live outside Hong Kong, the mandatory consumer-protection rules of your country of residence (for example, the legal guarantee of conformity in the EU and the UK) also continue to apply to you.
10. Our liability
We are responsible for loss or damage you suffer that is a foreseeable result of our breaking these terms or failing to use reasonable care and skill. We do not exclude or limit liability where it would be unlawful to do so, including for death or personal injury caused by our negligence, for fraud, or for your statutory rights as a consumer. We are not responsible for damage caused by installation that does not follow the product instructions, by fixings unsuitable for your wall, or by loads above the stated maximum.
11. Promotions
We do not currently run promotions. If we do, the conditions of each promotion will be shown with it and will apply in addition to these terms.
12. Your personal data
We use your personal data as described in our Privacy Policy and our Personal Information Collection Statement.
13. If something goes wrong
Contact us first at support@gemavelle.shop. We reply within one business day and try to resolve every complaint within 14 days.
If we cannot resolve it and you are in Hong Kong, the Consumer Council offers a free complaint and conciliation service. The Consumer Council is not a regulator and cannot make binding decisions. For claims up to HK$75,000 you may also use the Small Claims Tribunal, which is designed to be used without a lawyer.
If you live outside Hong Kong, you can contact the consumer advice body in your own country (for example, the European Consumer Centre in your EU country), and the mandatory consumer-protection rules of your country of residence continue to apply to you. We are not obliged and do not currently commit to take part in proceedings before an alternative dispute resolution body.
14. Governing law and jurisdiction
These Terms and any dispute or claim arising out of or in connection with them (including non-contractual disputes or claims) are governed by and construed in accordance with the laws of the Hong Kong Special Administrative Region.
The Hong Kong courts have non-exclusive jurisdiction. Nothing in this clause affects your right, as a consumer, to bring proceedings in the courts of the country where you are resident, or to rely on mandatory consumer-protection rules of that country.
15. Changes to these terms
We may update these terms from time to time. The version that applies to your order is the one shown on this page when you placed it.
